Form 1023 vs. 1023-EZ
One of the most common points of confusion for new nonprofits is deciding which IRS application to file when seeking 501(c)(3) status. Choosing the wrong form can lead to delays, denials, or compliance issues down the line.
The 1023-EZ
The 1023-EZ is only available to nonprofits that meet strict eligibility requirements, including limits on projected revenue, asset size, and organizational structure. Certain types of organizations, such as those with complex governance models or specific program activities, are automatically excluded. Because the EZ form relies largely on self-certification, errors or misunderstandings during filing may not be caught immediately, but they can create serious problems if the IRS later reviews the organization’s status.
Standard Form 1023
The standard Form 1023, while more detailed, provides a fuller opportunity to explain your mission, governance, and planned activities. This level of disclosure can be especially important for nonprofits with long-term growth plans, grant-seeking goals, or complex funding sources. A thorough application helps establish credibility from the start and reduces the risk of future challenges related to your tax-exempt status.
Choosing the Right Path
Determining the right path takes more than checking boxes. It means understanding how today’s filing choice affects your nonprofit’s future operations, reporting obligations, and public perception.
With over 20 years of experience guiding organizations through nonprofit formation and compliance, our lawyer helps clients evaluate not just what is allowed, but what makes the most sense for their mission and long-term sustainability.

“My parents had both passed, and I was in the process of closing and selling the house. My first attorney made enough mistakes in the selling of the house that it ended in Probate. I contacted Carig Law, and with Katy and Melody walking through the Probate process, which I thought would be a nightmare, was relatively quick and painless. I would highly recommend Carig Law, and if I ever needed an attorney, I would definitely give Carig Law a call.”- Bruce B.
