What a Michigan Last Will & Testament Actually Controls

A will gives the person making it, called the testator under Michigan law, the ability to direct what happens to their property and name the people responsible for carrying out those directions. Michigan law (MCL 700.2501) requires the testator to be at least 18 years old and of sound mind at signing.

Michigan also recognizes holographic wills, which are handwritten and dated without witnesses, if the signature and all material portions are in the testator’s own handwriting.

Notarization isn’t required for validity, but adding a notarized self-proving affidavit under MCL 700.2504 means the will can be admitted to probate at the Presque Isle County Probate Court in Rogers City without requiring witnesses to appear and testify.
