What a Revocable Living Trust Is Under Michigan Law

A revocable living trust is a legal arrangement you create during your lifetime. You transfer assets into the trust, which you control as the trustee. You’re also the grantor, the person who creates and funds the trust, and you name a successor trustee to step in if you become incapacitated or pass away. Michigan recognizes revocable living trusts as a valid estate planning instrument under EPIC.

The key difference from a will is timing and process. A will only takes effect after death and must go through probate before it can be enforced. A funded trust can operate outside of court supervision, and it addresses incapacity too: if you can no longer manage your affairs, your successor trustee can step in without a court-appointed conservatorship or guardianship proceeding.
