Conservatorship vs. Guardianship in Michigan

Both roles fall under Michigan’s Estates and Protected Individuals Code (EPIC), but they cover different ground. A guardian makes personal decisions for an incapacitated adult: where they live, what medical treatment they receive, and how daily care is managed. A conservator manages financial matters for the protected individual, including bank accounts, bills, investments, and tax filings, but has no authority over personal or medical decisions.

Some families need both a guardian and a conservator appointed for the same person. Others need only one, depending on what the protected individual can and can’t manage independently. Identifying that scope early keeps the court process focused and avoids granting broader authority than the situation actually requires.

The Conservatorship Appointment Process

The process begins with a petition filed in the probate court of the county where the individual lives. Michigan law requires notice to the person named in the petition and to other interested parties, typically close family members. The court can only appoint a conservator after finding, by clear and convincing evidence, that the statutory grounds are satisfied. Clear and convincing evidence is generally considered the most demanding standard used in civil cases in Michigan.

The Guardian Ad Litem & the Hearing

In most cases, the court appoints a guardian ad litem, an independent appointee who investigates the circumstances, considers whether a less restrictive alternative would be appropriate, and reports to the court. The individual named in the petition has the right to attend the hearing, be represented by counsel, present evidence, and cross-examine witnesses.

Michigan law directs courts to encourage maximum self-reliance and independence for the protected individual. If the petition is granted, the court issues Letters of Conservatorship confirming the conservator’s authority, which may be limited in scope to match the person’s specific limitations rather than granting blanket financial control.

Ongoing Duties After Appointment

Appointment is the beginning, not the end. A conservator is a fiduciary who must act primarily for the benefit of the protected individual, and conservatorship funds should not be commingled with the conservator’s personal accounts.

Practical obligations include:

• Inventory filing: A conservator must file an inventory of the protected individual’s assets with the court, with timing and procedure governed by Michigan Court Rules.
• Annual accountings: Conservators must file accountings with the court on a regular basis. The court may require a physical check of the estate, and the protected individual and interested persons are entitled to copies.
• Record-keeping: Thorough documentation of all transactions helps protect the conservator and demonstrates compliance with fiduciary obligations.

A conservatorship ends when the protected individual regains the ability to manage their finances, passes away, or the court determines the arrangement is no longer necessary. Any interested party may petition the court to modify or terminate it.

When a Conservatorship May Not Be Necessary

Michigan law directs courts to consider whether an appropriate alternative exists before granting a petition. A valid durable financial power of attorney, signed while a person still has legal capacity, can allow a trusted agent to manage finances without court involvement, which can help a family avoid the time, cost, and formality of a court proceeding.

Timing matters. A power of attorney must be signed before capacity is lost for it to work as an alternative. Michigan enacted a package of EPIC Omnibus amendments in 2024 (Public Acts 1 through 4) that updated several conservatorship and related procedures, making it worth reviewing existing documents against current law.
