Michigan Probate Process: Step by Step

Michigan estate administration is governed by the Estates and Protected Individuals Code (EPIC). Understanding the sequence of required steps helps personal representatives plan ahead and avoid missteps that can delay closing or create liability.

Opening the Estate

Formal probate begins with filing a Petition for Probate and/or Appointment of Personal Representative with the Presque Isle County Probate Court. Once filed, notice must be provided to all heirs, beneficiaries, and interested parties. Publication may be required for unknown addresses or to satisfy creditor notice requirements. The court typically schedules a hearing three to four weeks after filing. If the petition is approved, the court issues Letters of Authority, giving the personal representative the legal standing to act on the estate’s behalf.

Creditor Claims & Asset Inventory

After receiving Letters of Authority, the personal representative must publish a Notice to Creditors. Michigan law allows four months for creditors to submit claims. Separately, Michigan law requires the personal representative to inventory and appraise all estate assets within 91 days of appointment. Both deadlines run concurrently with other administration tasks, so staying organized during this period is critical.

Distribution & Closing

Once the creditor claim period closes, the personal representative pays valid claims and expenses, files any required tax returns, and distributes remaining assets to beneficiaries according to the will or Michigan’s intestate succession rules. Before the estate can be closed, an inventory fee based on the estate’s total value must be paid to the court. Straightforward Michigan estates typically take seven months or more to complete; complex or contested estates can take a year or longer.

Michigan Small Estate Options

Not every estate requires full formal probate. Michigan offers simplified procedures for qualifying estates that can meaningfully reduce both time and cost.

Simplified Petition & Order for Assignment

For 2026, if an estate is valued at $53,000 or less (subject to annual adjustment under Michigan law), the personal representative may be able to use a simplified petition and order for assignment process. This approach is faster and less expensive than full probate and avoids many of the steps in the standard formal process.

Transfer by Affidavit

For estates valued at $27,000 or less (also subject to annual adjustment under Michigan law) that don’t include real property, a successor may be able to claim certain assets through a transfer-by-affidavit process without any court involvement. Assets held in a properly funded living trust generally pass entirely outside the probate process.
